Healthcall (“us”, “we”, or “Healthcall”, which also includes its affiliates) is the author and publisher of the internet resource www.healthcall.in (“Website”) on the world wide web as well as the software, services and applications provided by Healthcall, including but not limited to the mobile application ‘Healthcall’, and the software, services and applications of the brand names ‘Healthcall Ray’, ‘Healthcall Tab’, ‘Healthcall Reach’, ‘Healthcall Hello’, ‘Assured’ and ‘Health Account’ (together with the Website, referred to as the “Services”).

This privacy policy (“Privacy Policy”) explains how we collect, use, share, disclose and protect Personal information about the Users of the Services, including the Practitioners (as defined in the Terms of Use, which may be accessed via the following weblink https://healthcall.in/privacy (the “Terms of Use”)), the End-Users (as defined in the Terms of Use), and the visitors of Website (jointly and severally referred to as “you” or “Users” in this Privacy Policy). We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. Your use of and access to the Services is subject to this Privacy Policy and our Terms of Use. Any capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms of Use.

BY USING THE SERVICES OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE PRIVACY POLICY. YOU HEREBY CONSENT TO OUR COLLECTION, USE AND SHARING, DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. WE RESERVE THE RIGHT TO CHANGE, MODIFY, ADD OR DELETE PORTIONS OF THE TERMS OF THIS PRIVACY POLICY, AT OUR SOLE DISCRETION, AT ANY TIME. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY AT ANY TIME, DO NOT USE ANY OF THE SERVICES OR GIVE US ANY OF YOUR INFORMATION. IF YOU USE THE SERVICES ON BEHALF OF SOMEONE ELSE (SUCH AS YOUR CHILD) OR AN ENTITY (SUCH AS YOUR EMPLOYER), YOU REPRESENT THAT YOU ARE AUTHORISED BY SUCH INDIVIDUAL OR ENTITY TO (I) ACCEPT THIS PRIVACY POLICY ON SUCH INDIVIDUAL’S OR ENTITY’S BEHALF, AND (II) CONSENT ON BEHALF OF SUCH INDIVIDUAL OR ENTITY TO OUR COLLECTION, USE AND DISCLOSURE OF SUCH INDIVIDUAL’S OR ENTITY’S INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

1. WHY THIS PRIVACY POLICY?

This Privacy Policy is published in compliance with, inter alia:

  • Section 43A of the Information Technology Act, 2000;
  • Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);
  • Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

This Privacy Policy states the following:

  • The type of information collected from the Users, including Personal Information and Sensitive Personal Data or Information relating to an individual;
  • The purpose, means and modes of collection, usage, processing, retention and destruction of such information; and
  • How and to whom Healthcall will disclose such information.

2. COLLECTION OF PERSONAL INFORMATION

Generally some of the Services require us to know who you are so that we can best meet your needs. When you access the Services, or through any interaction with us via emails, telephone calls or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you. You hereby consent to the collection of such information by Healthcall. Information collected by us from you may include (but is not limited to) the following:

  • contact data (such as your email address and phone number);
  • demographic data (such as your gender, your date of birth and your pin code);
  • data regarding your usage of the services and history of the appointments made by or with you through the use of Services;
  • insurance data (such as your insurance carrier and insurance plan);
  • other information that you voluntarily choose to provide to us including any images and other documents/files.
  • data shared by the Practitioners pertaining to the treatment availed by you.

“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.

The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

  • passwords;
  • financial information such as bank accounts, credit and debit card details or other payment instrument details;
  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • biometric information;
  • information received by body corporate under lawful contract or otherwise;
  • visitor details as provided at the time of registration or thereafter; and
  • call data records.

Healthcall will be free to use, collect and disclose information that is freely available in the public domain without your consent.

3.1 ALL USERS NOTE:

This section applies to all users.

3.1.1 A condition of each User’s use of and access to the Services is their acceptance of the Terms of Use, which also involves acceptance of the terms of this Privacy Policy.

3.1.2 An indicative list of information that Healthcall may require you to provide to enable your use of the Services is provided in the Schedule annexed to this Privacy Policy.

3.1.3 All the information provided to Healthcall by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You understand that Healthcall may use certain information for providing you the Services, for research/analytics (anonymized), communication of appointments, debugging customer support, or contacting you to complete transactions. By accessing and using the Website and/or verifying your contact number with Healthcall, You have explicitly consented to receive all above stated communications (call, SMS, email, or other electronic means) from Healthcall.

3.1.4 Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information’ under the SPI Rules requires your express consent.

3.1.5 Healthcall specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services.

3.1.6 You are responsible for maintaining the accuracy of the information you submit to us. If your personal information changes, you may correct, delete inaccuracies, or amend information by emailing privacy@healthcall.in.

3.1.7 If you wish to cancel your account or request that we no longer use your information, contact us through support@healthcall.in. We will retain your information for as long as your account is active and as needed to provide you the Services.

3.1.8 If you wish to opt-out of receiving non-essential communications, please email support@healthcall.in.

3.1.9 Healthcall may require the User to pay with a credit card, wire transfer, debit card or cheque. Healthcall will collect such User’s financial details solely for the billing and payment processes, secured through secured payment gateways.

3.1.10 Healthcall automatically receives the URL of the site from which anyone visits, IP addresses, operating systems, browser types, and ISP names for analytics. The linkage between IP addresses and personally identifiable information is not shared.

3.1.11 The Website uses temporary cookies to store technical administration and research data. Cookies do not store any Personal Information. You may adjust your browser to disable cookies.

3.1.12 Unregistered Users can make appointments by providing their name and phone number. To create an account, Users provide names, email addresses, age, ZIP codes, and passwords.

3.1.13 Healthcall does not exercise control over external links or third party sites, and is not responsible for their privacy practices.

3.1.14 Healthcall disclaims any liability for reliance or misuse of communication shared publicly between Users.

3.1.15 Healthcall does not collect information about the visitors of the Website from other sources, such as public records, save for registration.

3.1.16Healthcall maintains a strict "No-Spam" policy.

3.1.17 - 3.1.19 Healthcall has implemented best security policies, rules, and technical measures to protect the personal data under its control. Healthcall will only disclose Personal Information when required by law or to enforce its Terms.

3.2 PRACTITIONERS NOTE:

This section applies to all Practitioners.

3.2.1 - 3.2.2 As part of the registration process, certain Personal Information or Sensitive Personal Data is collected from Practitioners.

3.2.3 Practitioners’ personally identifiable information is used to describe and identify themselves. Healthcall may use such information for listing, product feedback, software usage patterns, and enlisting services.

3.2.4Healthcall automatically enables listing of Practitioners' information. The details listed are displayed when End-Users search for doctors. Practitioners are strongly encouraged to check their listed details and inform Healthcall of any discrepancies.

3.2.5 Healthcall may display information for verified Practitioners who have not registered, provided they have consented to enlisting.

3.3 END-USERS NOTE:

This section applies to all End-Users.

3.3.1 - 3.3.3 End-Users can access, modify, and delete their collected information using options on the Website. You can also email privacy@healthcall.in to delete all records.

3.3.4End-Users' personally identifiable information is used to help describe/identify themselves. Demographic and health data may be anonymized and used for product designs and analytics.

3.3.5 - 3.3.6 Healthcall communicates with End-Users via email and phone. Optional surveys and contests may be conducted to collect customer feedback.

3.3.7End-Users availing Services from "Assured" badged clinics consent to sharing medical records with Healthcall for effective scheduling and booking validation.

3.3.8 - 3.3.11 Healthcall keeps records of booking inquiries and phone calls for quality and support. Employees and processors are bound to strict confidentiality. Contractors processing data are bound by privacy requirements.

3.3.12 (Chat Specialist Matcher): Healthcall operates an automated chat-based assistant to help End-Users identify appropriate medical specialties and route bookings to local clinics/doctors. When you use this chat assistant, Healthcall collects and processes the conversation logs and inputs you provide (such as symptoms, general health queries, preferred locations, and appointment times). This information is processed securely and is used solely to match you with practitioners, manage appointment bookings, and improve scheduling. The chat assistant does not perform diagnostic clinical analysis, prescribe medications, or offer clinical/medical advice.

3.4 CASUAL VISITORS NOTE:

This section applies to Casual Visitors.

3.4.1 No sensitive personal data or information is automatically collected by Healthcall from casual visitors merely browsing the Website.

3.4.2 - 3.4.3 Casual visitors must agree to these terms; simply closing the browser will ordinarily clear all temporary cookies. Visitors are encouraged to clear browser cookies.

3.4.4 Anyone who willingly submits personal details (via email or registration) is treated as a Registered User under this policy.

3.5 HEALTHCALL UNITED ARAB EMIRATES ('UAE') USER REGION POLICY

This section details privacy rules applicable in the United Arab Emirates (UAE) region in compliance with the **UAE Personal Data Protection Law (PDPL) (Federal Decree-Law No. 45 of 2021)**:

  • UAE Users have the right to request access, correction, restriction, erasure, and portability of their personal files and health booking history.
  • Data processing is carried out based on User consent to provide clinic scheduling, online queue management, and routing services.
  • All data controllers or processing activities related to UAE users are subject to these standards. Direct UAE-related privacy requests to privacy@healthcall.in.

3.6 HEALTHCALL UNITED STATES OF AMERICA ('USA') USER REGION POLICY

This section details privacy rules applicable in the United States of America (USA) region, complying with **HIPAA** and state-level guidelines such as the **CCPA/CPRA**:

  • **HIPAA Compliance:** Healthcall complies with Protected Health Information (PHI) standards. Any patient data transmitted to US-based providers is handled under Business Associate Agreement (BAA) structures where necessary.
  • **CCPA/CPRA Consumer Rights:** California residents have the right to request access to their collected data profiles, verify details, and request complete erasure. Healthcall does not sell or lease personal data.
  • Submit US region consumer requests or exercise CCPA opt-outs by sending details to privacy@healthcall.in.

4. CONFIDENTIALITY AND SECURITY

4.1 Personal Information is maintained in electronic form on Healthcall equipment and databases. Healthcall implements reasonable security practices commensurate with safety standards.

4.2 - 4.3 No administrator at Healthcall knows your password. Users must protect credentials. Access is restricted to employees and contractors on a need-to-know basis.

4.4 - 4.6 Healthcall helps doctors store, manage, and share electronic records with patients. Healthcall is not responsible for data breaches caused by external ISP qualities, Government actions, or hacking beyond control.

5. CHANGE TO PRIVACY POLICY

Healthcall may update this policy. In case of significant changes, a notice will be displayed on the Website or sent via email. To object to changes, deactivate your account by contacting support@healthcall.in.

6. CHILDREN’S AND MINOR’S PRIVACY

Healthcall does not intentionally collect information from minors. Parents are encouraged to supervise minor activity online.

7. CONSENT TO THIS POLICY

Becoming a User of the Website signifies unconditional consent to this Privacy Policy.

Indicative List of Information by Nature of Service

1. End-Users registering for an account:

Name, mobile number, email, and password. Consent is provided to record telephone calls via telephony systems for bookings and scheduling.

2. Guest End-Users using the Website:

Mobile number, name, and confirmation logs. Call logs are stored for clinical appointment confirmation.

3. Practitioners registering for an account:

Name, specialty, credentials, clinic hours, consulting fees, and contact details.

4. Practitioners listing without an account:

Details collected from public domain resources or direct agent confirmation. Practitioners can email support@healthcall.in to be delisted.

5. Practitioners using Healthcall Ray / Tab:

Practitioner agrees to the digital signature collection and usage rules inside clinical notes, prescriptions, and EHR folders.

6. Practitioners using Healthcall Reach, Consult, and Assured badge platforms:

Name, phone numbers, and treatment data mapping consents.
